The Homestead Act allows an individual to protect their primary residence up to $500,000 from any attachment, or execution or sale to satisfy a debt. Very simple information is needed to file a Homestead Act in which you reside. This filing may be done in the town or city clerk’s office. You will be asked to provide the book and page number for your deed or for your certificate of Title #. Homestead Act forms may be obtained at most Registry of Deed offices. To find your local office go to www.sec.state.ma.us/rod. The cost to file a Declaration of Homestead is $35. Remember, the Homestead protection is not a substitute for homeowner’s insurance. The Homestead protection will be effective only after any liability insurance is used to pay for any judgements against you.
